These Terms and Conditions (hereinafter "T&C") govern the use of the services offered by Ellie Care (hereinafter "the company", "we", or "our"). By subscribing to and using our services, you fully accept these T&C.
1. Service Description
Ellie Care is a 24-hour, 7-day-a-week (24/7) telecare and assistance service that operates through a Samsung smartwatch (hereinafter "Ellie Watch"). The service includes:
- Continuous monitoring of vital signs (heart rate, SpO2, physical activity)
- Automatic fall detection
- SOS button for emergencies
- Professional assistance center available 24 hours a day
- Notifications to designated emergency contacts
- Coordination with emergency services when necessary
- Periodic health reports
2. User Obligations
By using Ellie Care services, the user agrees to:
- Provide truthful and up-to-date information at the time of registration and during the term of the service.
- Use the Ellie Watch in accordance with the instructions provided.
- Keep the device charged and in working condition.
- Not tamper with, disassemble, or modify the device hardware or software.
- Designate at least one valid emergency contact.
- Notify any changes in health status relevant to the service provision.
- Not misuse or fraudulently use the emergency service.
- Comply with all applicable laws and regulations.
3. Device (Ellie Watch)
3.1 Delivery terms
The Ellie Watch may be delivered to the user under the following terms:
- Loan (comodato): the device is the property of Ellie Care and is lent to the user for the duration of the subscription. The user must return it in good condition upon termination of the contract.
- Purchase: the user acquires ownership of the device. In this case, the device remains the user's property regardless of the subscription status.
3.2 Device responsibility
- Under the loan arrangement, the user is responsible for the care of the device during the term of the service.
- Damage caused by misuse, negligence, or causes unrelated to manufacturing defects shall be the user's responsibility.
- The user may not assign, lend, or transfer the device to third parties without prior authorization from Ellie Care.
4. Subscription and Payments
4.1 Plans and pricing
Ellie Care offers different subscription plans with features and prices detailed on our website. Prices may be subject to modifications, which will be communicated at least 30 days in advance.
4.2 Billing
- Billing is done on a monthly basis, unless an annual plan or other specific period is contracted.
- Payment is automatically debited using the payment method registered by the user.
- In case of non-payment, Ellie Care reserves the right to suspend the service with prior notice.
4.3 Trial period
If a trial period is offered, its conditions will be specified at the time of subscription. At the end of the trial period, the service will automatically renew at the selected plan, unless previously cancelled.
5. Service Limitations
The user acknowledges and accepts that:
- The service depends on device connectivity (Bluetooth, Wi-Fi, or mobile network). Areas without coverage may affect service provision.
- Fall detection and health alerts are based on algorithms that, while highly accurate, do not guarantee 100% detection of all events.
- Ellie Care does not replace emergency medical services and does not constitute a medical care service.
- Health data provided is for guidance purposes only and does not constitute a medical diagnosis.
- The service may be temporarily interrupted for scheduled maintenance or force majeure events.
- Proper service operation requires the user to wear the device and keep it charged.
6. Limitation of Liability
- Ellie Care shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the service.
- Ellie Care's maximum liability in any case shall be limited to the total amount paid by the user in the 12 months prior to the event giving rise to the claim.
- Ellie Care is not responsible for failures in the telecommunications network, power outages, natural disasters, or other force majeure events that prevent service provision.
- The user is responsible for verifying that their emergency contact information is up to date and correct.
7. Cancellation
7.1 Cancellation by the user
- The user may cancel their subscription at any time, effective at the end of the current billing period.
- No refunds are issued for partial periods already billed.
- In the case of a loan arrangement, the user must return the device within 15 business days following cancellation.
7.2 Cancellation by Ellie Care
Ellie Care reserves the right to cancel the service in the following cases:
- Repeated non-payment (more than 60 days overdue).
- Improper or fraudulent use of the service.
- Breach of these T&C.
- Intentional damage to the device (under the loan arrangement).
8. Intellectual Property
All intellectual property rights over the software, application, website, trademarks, logos, and other Ellie Care content are the exclusive property of the company or its licensors. The user does not acquire any license or rights over such assets beyond the use necessary for the provision of the contracted service.
9. Modifications
Ellie Care reserves the right to modify these T&C at any time. Modifications will be notified to the user at least 30 days in advance through the website and/or email. Continued use of the service after notification shall constitute acceptance of the modifications.
10. Applicable Law and Jurisdiction
These T&C are governed by the laws of the Argentine Republic. For any dispute arising from the interpretation or performance of these T&C, the parties submit to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires, waiving any other jurisdiction that may apply.
